An arm's length salary is the salary or wage of people employed by the business who are not related to the owners or their spouses. However, some more distant family ties are eligible, as indicated in the diagram below.
Of course, the salaries of owners, shareholders, partners and limited partners do not qualify as arm's length salaries.
In relation to a given person, the wages of the following persons shall be considered non-arm's length: his or her spouse and his or her ascendants and descendants, his or her father and mother, father-in-law and mother-in-law, brothers and sisters, brothers-in-law and sisters-in-law, children, sons-in-law and daughters-in-law, grandchildren and their spouses.
In relation to the same person, the salary of the following persons is considered as at arm's length: aunts and uncles, cousins, nieces and nephews, as well as the nieces and nephews of his or her spouse.
